1. About This Policy

Clear Marketing Solutions Pty Ltd (ACN 169 004 504), trading as Clear Admin People (we, us, our), is committed to protecting the privacy of individuals whose personal information we hold.

This Privacy Policy explains how we collect, use, disclose, store and protect personal information in connection with our business activities. It applies to all personal information we collect through our website, our services, and our dealings with clients, candidates, staff and other individuals.

We are bound by the Privacy Act 1988 (Cth) (Privacy Act) and the thirteen Australian Privacy Principles (APPs) set out in that Act. Where our activities involve personal information about individuals located in other jurisdictions, additional laws may also apply.

Data Breach Notification
 

We comply with the Notifiable Data Breaches (NDB) scheme under the Privacy Act. If we suspect or become aware of a data breach involving your personal information that is likely to cause serious harm, we will quickly assess the situation. If an eligible breach is confirmed, we will notify you and the Office of the Australian Information Commissioner (OAIC) as soon as practicable, providing recommendations on how you can protect your data.

 

By using our website or engaging our services, you consent to the collection, use and disclosure of your personal information as described in this Policy.

2. What Personal Information We Collect

The personal information we collect depends on who you are and how you interact with us. We collect only what is reasonably necessary for our business activities.
 

2.1  Clients and Prospective Clients

We may collect:

•  name, title, business name and ABN;

•  contact details, including email address, phone number and business address;

•  information about your business, including industry, size, staffing needs and operational requirements;

•  billing and payment information; and

•  communications and correspondence between you and us.
 

2.2  Candidates – Recruitment as a Service (Australian Roles)

When we provide Recruitment as a Service (RaaS) on your behalf, we collect personal information about job candidates. This may include:
 

•  name, contact details and address;

•  resume, employment history and qualifications;

•  references and referee contact details;

•  results of structured interviews and screening assessments;

•  Predictive Index (PI) Behavioural Assessment profiles and reports (where the candidate has consented);

•  police check results and other background verification outcomes (where requested and consented to);

•  salary expectations and remuneration history; and

•  any other information a candidate voluntarily provides during the recruitment process.

We collect sensitive information (such as background check results) only with the candidate's explicit consent and only to the extent necessary for the relevant recruitment engagement.


2.3  Offshore Staff and Candidates – Outsourcing Relationship Management


We also facilitate the recruitment and placement of Philippines-based professionals into remote roles with our clients (Outsourcing Relationship Management, ORM). In this context we may collect:

•  name, contact details and identification information;

•  resume, work history, skills and qualifications;

•  government-issued identification (to the extent required by applicable Philippine law and our client's onboarding requirements);

•  employment contract details and role information; and

•  ongoing employment records as required.


2.4  Website Visitors


When you visit our website we may collect:

•  your IP address, browser type and device information;

•  pages visited, time spent and referring URLs; and

•  any information you submit through contact or enquiry forms.

3. How We Collect Personal Information

We collect personal information:

•  directly from you – when you contact us, complete a form, apply for a role, or engage our services;

•  from third parties – including referees, background check providers, job boards, professional networks (such as LinkedIn) and our clients (who may share candidate information with us in connection with a recruitment engagement);

•  from publicly available sources – including publicly listed professional profiles; and

•  automatically – through our website via cookies and analytics tools (see section 9).

Where practicable, we collect personal information directly from the individual concerned. Where we collect personal information about an individual from a third party, we take reasonable steps to notify that individual in accordance with APP 5.

4.  Why We Collect Personal Information and How We Use It

We use personal information for the following purposes:
 

4.1  Delivering Our Services

​

•  sourcing, screening and assessing candidates for Australian-based roles (RaaS);

•  facilitating the recruitment and placement of offshore staff for clients (ORM);

•  providing bookkeeping, payroll and related business services (Clear Business Services);

•  providing virtual administration, reception and sales support services (Clear Admin Tasks); and

•  managing client engagements, including executing agreements, issuing invoices and managing payment.
 

4.2  Operating Our Business

•  communicating with clients, candidates and staff;

•  maintaining internal records and systems;

•  improving our services, processes and website; and

•  complying with our legal and regulatory obligations.

4.3  Marketing

​

We may use your contact details to send you information about our services, where you have consented or where we are otherwise permitted to do so under applicable law. You may opt out of marketing communications at any time by contacting us at hello@adminpeople.com.au or by using the unsubscribe link in any marketing email.

We do not use personal information for any purpose that would be incompatible with the purpose for which it was collected, except with consent or as otherwise permitted by the Privacy Act.

5.  Disclosure of Personal Information

5.1  To Whom We Disclose

 

We may disclose personal information to:
• our clients – we share candidate profiles, assessment results, reference summaries and related recruitment materials with the client for whom the recruitment engagement is being conducted;
• our related entity B4B Solutions, Inc. (Philippines) – see section 5.2 below;
• our service providers – including background check providers, psychometric assessment providers (Predictive Index LLC), job advertising platforms, cloud software providers (including Microsoft 365, Xero and our CRM platform) and IT service providers, who assist us in delivering our services;
• referees and other verifiers – in connection with reference checks and background verification;
• professional advisers – including lawyers, accountants and insurers, where necessary; and
• regulators and law enforcement – where required or authorised by law.

We do not sell personal information to third parties. We do not share personal information for advertising or marketing purposes without consent.

5.2  Overseas Disclosure – Philippines (B4B Solutions, Inc.)
 

APP 8 NOTICE: We disclose personal information to an overseas recipient. By providing us with your personal information, or by engaging our services, you acknowledge this disclosure.

We operate a group structure that includes B4B Solutions, Inc., a company incorporated in the Philippines. B4B Solutions, Inc. employs our Philippines-based staff, manages our backend operations and delivers staffing and support services to us.

In the course of our operations, personal information about clients, offshore candidates and offshore staff may be disclosed to B4B Solutions, Inc. and may be stored on systems and infrastructure located in the Philippines.

Before disclosing personal information to B4B Solutions, Inc., we take reasonable steps to ensure it handles that B4B Solutions Inc:
• Is subject to a law, a binding scheme or contract which effectively upholds principles for fair handling of the information that are suitably similar to the Australian Privacy Principles, notably the Data Privacy Act 2012 (Philippines); or
• otherwise take appropriate measures to protect that information and to restrict how they can use that information in a manner consistent with and that does not breach the Australian Privacy Principles information.

B4B Solutions, Inc is subject to the Data Privacy Act 2012 (Philippines), which is a law, a binding scheme or contract which effectively upholds principles for fair handling of the information that are suitably similar to the Australian Privacy Principles).

By engaging our ORM services, clients acknowledge that offshore staff personal information will necessarily be processed in the Philippines. Where a client shares candidate or employee information with us for the purpose of an ORM engagement, they authorise us to disclose that information to B4B Solutions, Inc. as needed to deliver the services.

5.3  Third-Party Service Providers

 

Our third-party service providers may be located in Australia or overseas (including the United States and other countries where major cloud platforms operate). We take reasonable steps to ensure service providers are bound by appropriate data handling obligations consistent with this Policy and the Privacy Act.

We store personal information on secure electronic systems, including cloud-based platforms provided by reputable third-party providers. We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These measures include:
• access controls restricting who can view or modify personal information;
• use of password-protected and, where available, multi-factor authenticated systems;
• encryption of data in transit where supported by our platforms; and
• staff training and policies around the handling of personal information.

No method of data transmission or storage is completely secure. While we take reasonable precautions, we cannot guarantee absolute security. If you become aware of a security concern related to your personal information, please contact us immediately.

We retain personal information for as long as necessary to fulfil the purposes for which it was collected, or as required by law. When personal information is no longer needed, we take reasonable steps to destroy or de-identify it.

7.1  Your Right of Access

Under APP 12, you have the right to request access to the personal information we hold about you. To make an access request, please contact us using the details in section 10. We will respond to your request within a reasonable time (generally within 30 days).

We may decline to provide access in limited circumstances permitted by the Privacy Act, for example where providing access would unreasonably affect the privacy of another individual or would be unlawful. If we decline, we will tell you why (unless we are prohibited from doing so).

7.2  Your Right of Correction

Under APP 13, if you believe the personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, you may ask us to correct it. We will take reasonable steps to correct the information within 30 days of your request. If we decline to correct, we will explain why and note your request on file.

8. Privacy Complaints

If you have a complaint about the way we have handled your personal information, please contact us in writing at the details in section 10. Please describe your concern clearly so we can investigate and respond appropriately.

We will acknowledge your complaint promptly and endeavour to resolve it within 30 days. For complex matters, we will keep you informed of progress.
